The SBCP provides a local authority building control service for Mole Valley District Council, Reigate and Banstead Borough Council and Tandridge District Council (the Participating Authorities).  Tandridge District Council is the “host” authority, and this privacy notice tells you what to expect us to do with your personal information when you make contact with us or use our services. Each individual Participating Authority is the Controller for the personal data of residents in its administrative area which is processed by Tandridge District Council.

The type of personal information we collect

We currently collect and process the following information:

  • Personal identifiers such as your name address and contact details.
  • Customer financial information
  • The plans of your property (Please note that requests for copies of plans may be refused based on the designer’s Intellectual Property Rights)

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you in order for us to provide you with a building control service.

We also receive personal information, usually from sources working on your behalf such as:

  • Builders/architects etc.
  • Private Building Control Companies

We use the information that you have given us in order to provide you with a building control service and contact you when we need to.

We may share this information with your participating authority because it is the Data Controller for the administrative area in which you live.  Situations where your personal data is most likely to be shared are for the purpose of processing subject access or other access rights requests, complaints about the service, of financial transactions. Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

Article 6(1)(b) We have a contractual obligation; and/or

Article 6(1)(e) We need it to perform a public task.

How we store your personal information

Your information is securely stored by Tandridge District Council as the Host Authority for the data controllers for applications made to SBCP.

If you need to contact your own local authority for administrative reasons (such as to make a complaint about a service you have received or to exercise your subject access rights) then your local authority (as the Data Controller) will also process and securely store your personal information.

You have the right to ask us for copies of your personal information.

You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

These rights are subject to certain statutory exemptions (“the Exemptions”). The Exemptions are considered on a case by case basis by the relevant Participating Authority after it has received your request. You will be informed whether any Exemption applies, and if so the extent to which it applies after we have received your request.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
